I was called to the British Columbia bar in 1983 after graduating in business [B. Comm (1977); accounting, finance, computing], and Law [L.L.B. (1981)] from Queen's University. I'm comfortable with accounting issues and reports (financial statements, economic reports, losses and valuations). I practiced litigation for 18 years in a variety of disciplines. For two years (2000-2002), I was in-house counsel for a public company (Image Power Inc, a technology company specializing in JPEG image compression and ISO participation). I started my own tech company in 2003 in Robotics. Presently I am in-house counsel for two high-tech companies, managing intellectual property and licensing matters (including open source), as well as employer-employee issues. I've done mediation work in the fields of intellectual property and licensing, business dissolution, and insurance (personal injury & disability). In my spare time, I enjoy reading newspapers and news magazines, woodworking, gardening, long-distance motorcycle adventures (on/off-road), and caring for my pets.

I have enjoyed a successful mediation practice since 1998, based in Vancouver and Vancouver Island, and have mediated thousands of matters in all areas of British Columbia and also in Alberta. I am primarily involved in cases dealing with personal injury litigation, and have been involved in the insurance litigation industry since 1988. I have mediated numerous multi-party complex cases and specialize in resolving difficult large loss matters. As well, I am experienced conducting mediations on the Zoom platform for clients that are not able to participate in person.

I have extensive small business experience, farming experience, experience in the import/export business and the petroleum industry. In my leisure time I enjoy tending to my commercial vineyard on Vancouver Island and adventure touring by motorcycle in Canada and various foreign countries.

I graduated from UBC in 1989 with a BA. Until 2001, I worked for ICBC for 11 years managing a large and complex caseload of litigated personal injury claims, working closely with plaintiff and defence counsel to maintain an effective working relationship to negotiate the settlement of thousands of bodily injury matters. In 2001, in addition to running my own Independent Adjuster firm (2001-2006), I completed the Continuing Legal Education Advanced Civil Mediation course, then subsequently completed the Canadian Dispute Resolution Corporation’s Personal Injury Mediation Practicum. I have participated in thousands of hours of successful mediation over the past twenty years, including complex multi-party cases, and been a member in good standing with Mediate BC since 2001. In addition to my full-time mediation practice, I am serving as a Councillor in the District of West Vancouver. The political world is much like mediation, constantly dealing with multiple and competing interest groups. I am a huge proponent of mediation and its benefits to all parties involved and have directed my attention toward building a full-time mediation practice since 2001. I enjoy residing in West Vancouver with my wife and am active in my community. I am an avid golfer who enjoys traveling whenever possible.

Having been involved in the auto insurance business for close to 40 years, I have had the opportunity to participate directly in the resolution of thousands of claims. I have worked for ICBC as a senior claims examiner and as a senior manager. In addition, I have worked as a consultant for plaintiff law firms for a number of years, including working as a MVA Practice Manager for a busy law firm. This experience has allowed me to understand the technical complexities inherent in many disputes. It has also provided me with first-hand knowledge about what is required by insurance companies to properly assess and pay claims. Just as important, my experience has given me a great deal of insight into the tremendous toll injuries can have on individuals. I have participated in well over 1,000 mediations, primarily in B.C. but also in other jurisdictions in Canada and the U.S.A.

I have been a trial lawyer in British Columbia since 1981, and I was appointed Queen's Counsel in 2015, now King's Counsel. I have practiced personal injury, criminal, family, estate, commercial, and employment law. My practice now focuses on mediation, arbitration, and Med-Arb in personal injury, estate and wills variation, commercial, and employment matters.

Before every mediation, I speak with each lawyer separately to understand what is not in the brief and what concerns them most. Med-Arb begins as a mediation. If the parties settle, the file closes. If issues remain, I move into arbitration and deliver a binding written decision, as agreed in writing at the outset.

I am a Harvard certified mediator and a member of the Mediate BC Civil Roster, the Law Society of BC, the Canadian Bar Association, and the Trial Lawyers Association of BC. I am a past President of the Surrey Bar Association and of Baseball BC, and a director of Baseball Canada. I served 13 years as a Delta Parks Commissioner and 6 years on the Delta Police Board.

My wife and I have three sons who live locally. I enjoy photography, skiing, and travel.

I have been a practicing personal injury lawyer in since 1982.  My practice was in Kamloops with Morelli Chertkow where I was managing partner for 28 years prior to becoming associate counsel in 2022. Being in the interior of the province allowed me the flexibility to act for both plaintiff and defence, which I have done for my entire career. Acting on both sides has provided a unique perspective and insight on preparing and litigating personal injury cases. I have been mediating since 2001 after receiving requests from other counsel, as well as adjusters, who dealt with me over the years and respected my candour, common sense, and ability as counsel. I am a lawyer and have been operating my own law firm, Lehal Law Corporation, in Delta since 1992. I was called to the British Columbia Bar in 1990.

In the beginning of my practice I operated a general law firm where I practiced civil, personal injury, family, real estate, corporate, WCB, and immigration. Since 2020 my practice has been restricted to immigration and mediation/arbitration.

I have been a decision-maker on both the BC Review Board and the Civil Resolution Tribunal and am on the BC Civil Roster and Family Roster of Mediators.  I received training in mediation through the Harvard Law School Program of Negotiation. I am a certified arbitrator and can provide med-arb or arbitration services, and can also provide co-mediation services when necessary. I provide a supportive and safe environment for my mediations and work with the parties and their counsel to identify and address the interests in dispute. My approach to mediation is evaluative and I provide helpful feedback to help resolve disputes.

I was called to the bar of British Columbia in 1986 and have practiced civil litigation my entire career in the fields of personal injury, labour and employment and general civil litigation. I was appointed QC in 2016. Throughout my legal career at a prominent Fraser Valley law firm, I worked both for individual plaintiffs as well as doing defense work for ICBC and private insurance companies. I have extensive training in mediation through Continuing Legal Education Society of BC, the Trial Lawyers Association of BC and the Straus Institute for Dispute Resolution at Pepperdine University Caruso School of Law. I am also a certified Family Law Mediator. I have volunteered extensively in my community, having served on the boards of directors of the Reach Gallery Museum in Abbotsford, the Fraser Valley Healthcare Foundation, Abbotsford Minor Hockey Association and the Lower Mainland Ringette League. I have also coached minor hockey, ringette and fastball. I enjoy the outdoors, including playing golf, foraging for wild mushrooms, fishing and travel. 

 

I am currently a member of the Trial Lawyers Association of B.C. and the Law Society of B.C. I believe in an evaluative approach to mediation but often start a process through a facilitative approach. I believe that in-person mediations are most effective in aiding in the resolution of disputes, but  also recognize and value the practicality of the online option - so I embrace both types of venue. I am also available for co-mediation services.
